TERMS USED – SECTION 1
Key parties to the following terms and conditions, shall have the following explanations:
"Contract" means the terms and conditions entered into for the provision of tuition, between students over 18, or students and their nominees for students under 18 and Step Up.
"Step Up" means Step Up Home Tuition Limited, a registered company under the New Zealand Companies Act 1993. Chartered Accountants acting for Step Up, are Markhams Christchurch.
The Step Up company address is 5/164 Lyttelton Street, Spreydon, Christchurch 8024.
"Members" means registered users of the website whose purpose it is to use the features of the Members section to enter in a contractual relationship With Step Up Home Tuition.
"Tutor" means persons with the necessary qualifications, experience and expertise, using the Step up website to advertise their services as providers of home tuition, with a view to entering into contracts.
"Parents" means the parents or nominees of students under 18.
"Students" means those receiving tuition from Step Up tutors.
"Students over 18" means those students over 18 who are able to enter into tuition contracts on their own behalf, assuming all liabilities as independent signees.
OBLIGATIONS OF STEP UP – SECTION 2
The website has been established to allow parents and students over 18 to contact tutors, view their profiles and if agreeable, to enter into a tuition contract.
The website has been established for parents and students over 18 to view the information regarding the services Step Up provides.
OBLIGATIONS OF TUTORS – SECTION 3
Tutors may not vary the tuition charges specified by Step Up on this website and take full responsibility for the collection of such fees.
Tutors who enter into their own tuition arrangements must forward the Step Up fee specified on their contract to Step Up at the agreed intervals.
Tutors accept that failure to forward any monies owed to Step Up within 7 days of falling due, may incur a penalty payment of 15% of the amount due.
Tutors accept that Step Up is not liable to the tutor for the reimbursement of fees owing to them as a result of the cancellation of a contract.
Tutors declare that their profile details are accurate and current. Tutors understand that their information is publicly visible.
Tutors declare that they are over 18 years of age and possess the experience and qualifications stated on their profile.
No derogatory or abusive language may be used in the members area in regard to parents, students, or other tutors. Step Up reserves the right to cancel the membership of any tutor who breaches this condition.
Tutors assume full responsibility for the accuracy of information transmitted in communications with parents.
Tutors shall acknowledge that Step Up bears no responsibility for the accuracy of information released or gained in the Members area and accepts no liabilitiy regarding any actions arising from such information.
Tutors arranging their own contracts will secure payment directly from students or their nominees. Step Up will not intervene in these arrangements, nor will it pay any monies owing to tutors as a result of payment defaults.
If any contract arranged by a tutor is cancelled for any reason Step Up shall not be liable for reimbursement of fees to tutors.
Tutors shall not include any personal identification or contact information such as email addresses or phone numbers when posting messages in the Members area.
OBLIGATIONS OF PARENTS AND STUDENTS OVER 18 – SECTION 4
Parents or student nominees shall assume all responsibility for students under 18 when they enter into a contract.
Parents and students over 18 acknowledge that it is their responsibility to verify the credentials, expertise, references and Teacher Registration status of any tutor with whom they are entering or proposing to enter into a contract for tuition.
Parents and students over 18 shall not include any personal identification or contact information such as email addresses or phone numbers when posting messages in the Members area.
Parents and students over 18 shall not post any abusive or derogatory comments regarding tutors in any communications in the Members area.
Parents and students over 18 acknowledge that Step Up is not a party to contracts entered into with tutors, where the tutor has not been directly referred by them. As such, Step Up is not liable for any breach of conditions in contracts entered into without direct Step Up involvement.
Parents, students or third parties shall not use any information on the Step Up website, including its systems, methods or procedures, to gain a pecuniary advantage for themselves at the expense of Step Up.
PRIVACY POLICY – SECTION 5
This policy sets out the terms regarding the use and protection of information provided to Step Up for the operation of the website.
Step Up will make every effort to protect your privacy. Any information provided by you which may identify you, will be used solely in accordance with this privacy statement.
Step Up’s privacy policy will be updated periodically. Check this section of our Terms and Conditions for any future changes. This policy is effective from 1/5/09

- Contact information such as email addresses, postal addresses, home and mobile phone numbers
- Names and titles
- Area codes
- Other information relevant to registration, communication or newsletters.
Purposes of Information Gathering
- To improve the quality of our services
- To occasionally send information about new services or promotions
- To change our website features to better reflect your interests
- To email the contact details of tutors to you once you have decided to enter into a tuition arrangement. These details will only be released when we have received a request to do so which specifies the ID number of the tutor chosen.

We will make every effort to safeguard the information you provide through our verification systems and the monitoring of communications in the Members area.

MISCELLANEOUS – SECTION 6
Termination of Membership
You acknowledge that Step Up has the right to withdraw any submitted material on our website which breaches any part of our terms and conditions and which brings Step Up into disrepute.
You acknowledge that Step Up has the right to terminate the membership of any person who posts obscene or derogatory material in the Members area.
Disclaimer
Whilst every effort is made to ensure the accuracy of material appearing on our website, Step Up accepts no responsibility for the posting of inaccurate information accepted by us in good faith. Your use of the service Step Up provides, is accordingly at your own risk.
Members may not use the Members area for illegal purposes such as sending junk e-mail and spam. No advertising material is allowed in the Members area or the promotion of third party commercial entities.
